These Terms of Service ("Terms") govern your access to and use of the BeGrocer mobile application, website and related services ("Services").
BeGrocer is a local online grocery and consumer-products platform that facilitates the ordering, fulfilment and delivery of products to customers in its serviceable areas.
By accessing, downloading, registering for or using the Services, you agree to these Terms, our Privacy Policy, Refund & Cancellation Policy, Delivery Policy and Food Safety & Quality Policy.
If you do not agree with these Terms, please do not use the Services.
1. Eligibility
You must be legally capable of entering into a binding transaction under applicable Indian law to place an order through BeGrocer.
Where an account is created on behalf of a business or another legal entity, the person creating the account represents that they are authorised to do so.
BeGrocer may restrict or refuse access where required by law or where misuse of the Services is reasonably suspected.
2. Account Registration and Security
You agree to provide accurate and current information.
You are responsible for:
- Maintaining the confidentiality of your account;
- Keeping your mobile number and account information updated;
- Protecting your OTP and account credentials;
- Not allowing unauthorised persons to use your account; and
- Informing BeGrocer promptly if you suspect unauthorised account activity.
BeGrocer may suspend or restrict an account involved in fraud, abuse, promotional misuse or other violations of these Terms.
3. Products and Product Information
BeGrocer attempts to ensure that product information displayed on the Services is accurate and up to date.
However, product availability, packaging, photographs, sizes and manufacturer packaging may change.
For packaged products, information displayed online should correspond to applicable product labelling and regulatory requirements.
Product names, trademarks, brand names and packaging designs belong to their respective owners.
4. Fresh and Variable-Weight Products
Certain products, including fresh fruits and vegetables, may naturally vary in:
- Size;
- Weight;
- Shape;
- Colour;
- Texture; and
- Appearance.
Where a product is sold by estimated or variable weight, the final quantity and price may vary within reasonable limits and the final invoice may reflect the actual supplied quantity, subject to applicable law.
BeGrocer will not knowingly supply products that fail applicable food-safety requirements.
5. Orders and Order Acceptance
Placing an order constitutes a request to purchase products.
An order is not considered finally accepted until BeGrocer confirms the order.
BeGrocer may cancel or decline an order where:
- A product is unavailable;
- The requested location is outside the serviceable area;
- A product is found unsuitable during fulfilment;
- A pricing or catalogue error is identified;
- The product fails an applicable quality or safety check;
- Delivery cannot reasonably be completed;
- Fraudulent or abusive activity is suspected;
- Required regulatory requirements cannot be satisfied; or
- Cancellation is otherwise permitted by applicable law.
Where an order is cancelled by BeGrocer for reasons attributable to BeGrocer, applicable refunds will be processed in accordance with our Refund & Cancellation Policy.
6. Food Safety and Quality
Food products supplied through BeGrocer are subject to applicable food-safety laws and BeGrocer's Food Safety & Quality Policy.
BeGrocer maintains procedures for receiving, handling, storing and delivering applicable food products.
These procedures may include checks relating to:
- Expiry or best-before information;
- Packaging integrity;
- Visible contamination or infestation;
- Unusual appearance or colour;
- Unusual odour where sensory inspection is appropriate;
- Storage requirements;
- Labelling;
- Batch or lot information where applicable;
- Shelf-life requirements; and
- Other applicable food-safety requirements.
A product that does not satisfy applicable receiving requirements may be rejected, quarantined, removed from sale or otherwise handled in accordance with applicable law.
Sensory or visual receiving checks do not constitute laboratory testing and do not guarantee the absence of every possible defect or contamination.
7. Supplier and Manufacturer Responsibility
Where a product has a defect, contamination, mislabelling, adulteration, authenticity issue or other non-compliance that existed before BeGrocer received the product and was not caused or aggravated by BeGrocer, responsibility may lie with the applicable manufacturer, brand owner, supplier or seller, subject to applicable law.
Suppliers and sellers are required to provide products that comply with applicable laws and regulatory requirements.
Where applicable, suppliers must maintain valid FSSAI registration/licensing and provide required product and compliance information.
BeGrocer may suspend, reject, delist or discontinue products or suppliers where compliance concerns arise.
Nothing in these Terms excludes or transfers any responsibility that applicable law places directly upon BeGrocer.
8. BeGrocer's Responsibility After Receipt
Once a product has been accepted into BeGrocer's operational inventory, BeGrocer is responsible for maintaining applicable conditions under its control, including, as applicable:
- Proper storage;
- Hygiene;
- Pest-control measures;
- Appropriate temperature conditions;
- Stock rotation;
- Expiry monitoring;
- Appropriate handling;
- Protection against contamination;
- Appropriate segregation of products;
- Safe packing and delivery; and
- Applicable food-safety records and procedures.
Where a product becomes damaged, contaminated, expired or otherwise unsuitable due to conditions under BeGrocer's control after receipt, BeGrocer will take appropriate corrective action in accordance with applicable law and its customer policies.
9. Food Safety Incidents, Complaints and Recalls
If a customer believes that a food product is unsafe, contaminated, damaged or otherwise unsuitable for consumption, the customer should immediately stop using the product and contact BeGrocer through the available support channels.
BeGrocer may:
- Investigate the complaint;
- Request photographs, batch details or other information;
- Suspend sale of the affected product;
- Quarantine relevant stock;
- Contact the applicable supplier or manufacturer;
- Initiate or cooperate with a product recall;
- Notify relevant authorities where legally required; and
- Provide an appropriate remedy under applicable law and our customer policies.
Customers must not consume a product where they reasonably believe that it may be unsafe.
10. Product Shelf Life
BeGrocer will follow applicable shelf-life and food-safety requirements for products offered through its Services.
Where applicable regulatory requirements specify minimum remaining shelf life at the time of delivery, BeGrocer will take reasonable measures to comply with those requirements.
11. Pricing, Taxes and Charges
Prices are displayed in Indian Rupees.
Applicable taxes and charges will be displayed or reflected in the order or invoice as required.
Prices, promotions and availability may change before an order is accepted.
Delivery charges, handling charges or other applicable charges will be disclosed before order confirmation wherever required.
12. Payments
Payment methods available through BeGrocer may include supported digital payment methods and cash on delivery where available.
Payments processed through third-party payment providers are subject to the provider's applicable terms.
BeGrocer does not intentionally store complete payment-card credentials or UPI PINs.
If payment is successfully debited but the order is not confirmed, the payment provider may reverse or refund the amount according to its applicable processing timelines.
13. Delivery
Delivery timelines displayed in the Services are estimates unless expressly stated otherwise.
Delivery may be affected by:
- Traffic;
- Weather;
- Public restrictions;
- Order volume;
- Product availability;
- Incorrect or incomplete addresses;
- Customer unavailability; or
- Other circumstances beyond reasonable control.
Customers must provide accurate delivery information and reasonable access for delivery.
BeGrocer may contact the customer using the information provided in the order to complete delivery.
14. Delivery Personnel
Delivery personnel may be employees, contractors, partners or other authorised persons.
Customers must treat delivery personnel respectfully.
Threatening, abusive, discriminatory or unsafe behaviour towards delivery personnel is prohibited.
BeGrocer may refuse future deliveries or suspend accounts where serious misconduct or repeated abuse occurs.
15. Cancellation, Return and Refund
Cancellation, return and refund rights are governed by the applicable Refund & Cancellation Policy.
Nothing in these Terms limits any mandatory consumer right available under applicable law.
Products that are perishable or otherwise unsuitable for return may be subject to specific return conditions, except where applicable law provides otherwise.
Quality-related complaints should be reported as soon as reasonably possible after delivery.
16. Customer Responsibilities
You agree not to:
- Provide false information;
- Create fraudulent or duplicate accounts;
- Abuse promotional offers;
- Submit false product complaints;
- Repeatedly place and refuse genuine orders;
- Attempt to manipulate prices or payment systems;
- Attempt unauthorised access to BeGrocer systems;
- Scrape or systematically copy BeGrocer data;
- Reverse engineer the application except where legally permitted;
- Harass or threaten employees, vendors, delivery personnel or support staff; or
- Use BeGrocer for unlawful purposes.
17. Promotions and Offers
Promotional offers may have separate eligibility conditions.
Unless expressly stated otherwise:
- Offers cannot be exchanged for cash;
- Promotional codes may be limited to one account;
- BeGrocer may restrict promotions where abuse is detected; and
- BeGrocer may modify or discontinue promotions subject to applicable law.
18. Intellectual Property
The BeGrocer name, logo, software, interface, graphics, text, designs, original content and other intellectual property used in connection with the Services belong to BeGrocer or its licensors unless otherwise stated.
You receive a limited, non-exclusive, non-transferable and revocable right to use the Services for lawful personal purposes.
You may not reproduce, distribute, modify, sell or commercially exploit BeGrocer intellectual property without written permission.
Third-party trademarks remain the property of their respective owners.
19. Service Availability
BeGrocer aims to provide reliable Services but does not guarantee uninterrupted or error-free operation.
Services may temporarily become unavailable because of:
- Maintenance;
- Technical failures;
- Internet or telecommunications issues;
- Security incidents;
- Third-party service failures;
- Government restrictions;
- Natural events; or
- Other circumstances beyond reasonable control.
20. Disclaimer
To the maximum extent permitted by applicable law, BeGrocer does not guarantee that the Services will always be uninterrupted, completely error-free or available at all times.
Nothing in these Terms is intended to exclude mandatory rights, warranties, obligations or liabilities imposed by applicable consumer-protection, food-safety, data-protection or other laws.
21. Limitation of Liability
To the maximum extent permitted by applicable law, BeGrocer will not be liable for indirect, incidental, special or consequential losses arising from use of the Services.
Where legally permissible, BeGrocer's liability relating to a particular order may be limited to the amount paid for the affected order.
However, nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising under mandatory consumer-protection or food-safety laws.
22. Indemnity
To the extent permitted by applicable law, you agree to indemnify BeGrocer against losses, claims or expenses arising directly from:
- Your unlawful use of the Services;
- Fraudulent activity associated with your account;
- Your violation of these Terms; or
- Your violation of applicable law or the rights of another person.
This clause does not require you to indemnify BeGrocer for BeGrocer's own unlawful conduct or liabilities that cannot legally be transferred to you.
23. Suspension and Termination
BeGrocer may suspend or terminate an account where:
- These Terms are materially violated;
- Fraud or abuse is reasonably suspected;
- Continued access creates a security or safety risk;
- Required by law; or
- The account is used for unlawful purposes.
Customers may stop using the Services and request account deletion subject to applicable retention requirements.
24. Force Majeure
BeGrocer will not be responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, severe weather, government restrictions, public emergencies, infrastructure failures, widespread technical outages or other similar events.
This provision does not remove any mandatory statutory rights or obligations.
25. Governing Law and Dispute Resolution
These Terms are governed by the laws of India.
Customers may first contact BeGrocer through the available grievance and support channels.
Nothing in these Terms prevents a customer from exercising a statutory right to approach a competent consumer forum, regulatory authority, court or other authority where such right is available under applicable law.
Subject to the above, disputes may be submitted to the competent courts having jurisdiction in Maharashtra.
26. Changes to These Terms
BeGrocer may update these Terms when necessary to reflect:
- Changes in Services;
- Changes in business operations;
- Regulatory requirements;
- Changes in applicable law; or
- Security or operational requirements.
The updated version will be published on this page with a revised "Last Updated" date.
Where legally required, BeGrocer will provide additional notice regarding material changes.
